Questions people ask

Are late fees on rent legal?

In most states, yes, if the lease provides for one. Many states also set limits: a cap on the amount, a minimum grace period, or a rule that the fee must be reasonable rather than a penalty.

New York, for example, caps late fees at $50 or 5% of the monthly rent, whichever is less, and allows none until rent is more than 5 days late. This is general information, not legal advice for your state.

How much is a typical late fee?

Common lease terms are a flat $50 to $100, or 5% to 10% of the monthly rent. On $1,500 rent, 5% is $75.00.

Where a state caps late fees, the cap wins over the lease. Where there is no cap, courts look for a fee that fits the landlord’s real cost of a late payment, not a penalty.

What is a grace period?

Days after the due date when rent can still be paid without a fee. This calculator counts them after the due date: rent due on the 1st with 5 grace days can be paid through the 6th with no fee.

Some states set a minimum. Massachusetts allows no late fee until rent is 30 days late, and Texas none until rent has gone unpaid two full days after the due date. Leases often give 3 to 5 days where the state sets none.

Can a landlord charge a late fee every day?

Often, if the lease says so and the total stays within state limits. A daily fee usually runs from the end of the grace period until the rent is paid, and a well-written lease caps the total.

Some states cap the whole late fee however it is charged, so a daily fee can hit the limit within days. Choose Per day above, with a cap, to see where it lands.

What if the lease has no late fee clause?

Then there is usually no late fee to charge. A landlord generally can’t add one mid-lease or collect one the lease never mentioned; the lease, or a signed change to it, has to set the fee first.

Late rent still has consequences without a fee: the landlord can typically serve a notice to pay or leave, following the state’s rules.
