Questions people ask

How much notice do I need to give?

For a month-to-month tenancy, 30 days is the most common rule: 36 states ask tenants for 30 days. Some ask landlords for more: Washington 60 days, Oregon 90 days after the first year, California 60 days once a tenant has lived there a year.

A few states count to the end of a rental period instead of a set number of days. Pick your state above and the letter checks your dates against its rule.

Does a notice to vacate have to be in writing?

Almost always. Most states require written notice, and the lease often says how to deliver it: by hand, by mail, sometimes by email.

Keep a copy and write down the day you delivered it and how. Some states add days when a notice is mailed.

Can a landlord end a month-to-month tenancy without a reason?

In most states, yes, with the right notice. A growing number require a reason the law lists, often called just cause: Washington, New Jersey and DC, Oregon after the first year, and California for many longer tenancies.

Ending a tenancy to retaliate against a tenant or to discriminate is illegal everywhere.

What if I need to move out before my lease ends?

A fixed-term lease runs to its end date. Leaving early usually means paying rent until the unit is rented again or the term ends, unless the lease has an early-termination clause.

Many states let tenants end a lease early for military orders or domestic violence. Otherwise, ask the landlord first: many will agree to a lease break in writing.
