Georgia security deposit law

Georgia landlords have 30 days to return a security deposit after you move out. The deposit can’t be more than 2 months’ rent.

The limit
Applies to leases entered into or renewed on or after July 1, 2024 (Safe at Home Act). Escrow, damage-list, and penalty rules do not apply to individuals owning 10 or fewer units unless a paid third party manages them.
The deadline
Within 30 days after the landlord obtains possession, with a written statement of reasons and the move-out damage list for any amount kept.
Interest
Deposits must be held in an escrow account or covered by a surety bond, but interest is not required.
Deductions
The landlord must give you an itemized list of anything kept from the deposit.
If it isn’t returned
Three times the amount improperly withheld plus reasonable attorney’s fees (only the amount withheld for a bona fide error). Missing the deadline forfeits the right to withhold or sue for damages to the premises.
