New York notice to vacate rules

In New York, landlords and tenants must each give 30 days’ notice to end a month-to-month tenancy. For unpaid rent, the notice period is 14 days.

Landlord ends month-to-month: 30 days
Tenant ends month-to-month: 30 days
Week-to-week: No fixed period
Unpaid rent: 14 days
Lease violation: No fixed period

Unpaid rent: 14-day written rent demand before a nonpayment proceeding (RPAPL § 711(2)).
Lease violations: No statewide notice period for lease violations; lease and local rent rules govern. Landlord notice to end a tenancy is 30, 60 or 90 days depending on length of occupancy (RPL § 226-c).
