Periodic tenancy

A periodic tenancy is a tenancy that runs one rental period at a time, such as week to week or month to month, and renews itself until one side gives proper notice. The period usually follows how often the rent is paid.

Example

A tenant who pays $350 every Friday has a week-to-week tenancy; one who pays $1,500 on the 1st has a month-to-month tenancy. If a written lease is silent about its length, many states treat the tenancy as periodic, based on how often rent is due, and the notice needed to end it follows that interval: often 7 days for week to week and 30 days for month to month. A year-to-year tenancy is also periodic, though rare in home rentals.

Tenant rents the premises on a week-to-week basis at $350 per week, payable each Friday in advance. Either party may end this tenancy by written notice given at least seven days before the end of a rental week.

Each state sets the notice to end a week-to-week or month-to-month tenancy, and some count it to the end of a rental period rather than from the day the notice is delivered.
