Month-to-month tenancy

A month-to-month tenancy is a rental with no fixed end date that renews itself each month until the landlord or the tenant gives written notice to end it. It can start from a signed month-to-month agreement, or when a fixed-term lease ends and the tenant stays on, paying rent the landlord accepts.

Example

A tenant pays $1,300 on the 1st of each month and hands the landlord a written 30-day notice on September 30, 2026. In a state that counts notice to the end of a rental period, the tenancy ends October 31 and October is the last month owed; in a state that counts 30 days from delivery, it could end October 30. Either way, the landlord can raise the rent or end the tenancy the same way, with the notice state law requires.

By state

Notice periods differ a lot: 7 days in North Carolina, 30 in most states, 60 for a California landlord once the tenant has been there a year, and 90 for an Oregon landlord after the first year.
