South Dakota notice to vacate rules

In South Dakota, landlords and tenants must each give 30 days’ notice to end a month-to-month tenancy. For unpaid rent, there’s no fixed notice period.

No pre-filing notice required: 2024 legislation repealed the 3-day notice to quit (§ 21-16-2). An eviction may be filed once rent is 3 days past due; the lease may still require notice.
Lease violations
No statutory notice or cure period; eviction lies where the tenant breaches a lease term that ends the lease. Periodic tenancies end on notice equal to the rental period, capped at one month (so ‘one month’, not a fixed 30 days).
