West Virginia notice to vacate rules

In West Virginia, landlords and tenants must each give 30 days’ notice to end a month-to-month tenancy. For unpaid rent, there’s no fixed notice period.

The rule

Landlord ends month-to-month
30 days
Tenant ends month-to-month
30 days
Week-to-week
7 days
Unpaid rent
No fixed period
Lease violation
No fixed period
Unpaid rent
No statutory pre-filing notice; a landlord may petition for summary relief once the tenant is in arrears, and the hearing is set 5–10 judicial days after filing.
Lease violations
No statutory notice or cure period for breach of a lease covenant or damage to the property. Periodic tenancies end on notice of one full rental period (so ‘one month’, not a fixed 30 days), unless the agreement sets another period.
