North Dakota notice to vacate rules

In North Dakota, landlords and tenants must each give 30 days’ notice to end a month-to-month tenancy. For unpaid rent, the notice period is 3 days.

The rule

Landlord ends month-to-month
30 days
Tenant ends month-to-month
30 days
Week-to-week
7 days
Unpaid rent
3 days
Lease violation
3 days
Unpaid rent
Eviction is available once rent is 3 days past due, after a 3-day written notice of intention to evict. Month-to-month notice is ‘one calendar month’ (not a fixed 30 days).
Lease violations
3-day notice of intention to evict for violating a material term of a written lease; no statutory cure period. Week-to-week figure applies the rule that notice equals the rental period, capped at one month.
